ComCom approves the commercial transfer of the mobile radio licences as part of the planned takeover of Sunrise by Liberty Global

Bern, 04.11.2020 - As part of the planned takeover of Sunrise by Liberty Global, the Federal Communications Commission (ComCom) has approved the commercial transfer of Sunrise’s current mobile radio licences. The licence conditions will continue to be fulfilled and the competition in the mobile communications market will not be adversely affected by this takeover.

ComCom has concluded that Sunrise will continue to meet the licensing requirements after a takeover by Liberty Global. Sunrise continues to possess the necessary technical capabilities to provide its customers with high-quality mobile radio services. Moreover, competition in the mobile radio market will not be adversely affected by the planned takeover; the Competition Commission has already come to the same conclusion (cf. media release dated 30.10.2020). For these reasons ComCom has approved the commercial transfer of Sunrise’s licences.

If a company intends to take over a mobile radio licence holder, ComCom has to approve the commercial transfer of the licence. In this process, ComCom examines whether the statutory terms of the licence (e.g. technical capabilities) and the applicable law continue to be complied with under the new ownership conditions. In addition, ComCom ensures that competition in the telecoms market is not significantly affected (cf. Art. 23 TCA).
